These license terms are an agreement between Bassaly Computer Interfaces and you. Please read them. They apply to the software named above. These terms also apply to any updates, supplements, and services Bassaly Computer Interfaces supply to you unless other terms accompany those items.
 
By using the product named above, you accept these terms. If you do not accept them, do not use the software.
 
1. Scope of license: The software product named above is licensed, not sold. This agreement only gives you some rights to use and distribute the software under certain conditions. Bassaly Computer Interfaces reserves all other rights. Unless applicable law gives you more rights despite this limitation, you may use the software only as expressly permitted in this agreement. In doing so, you must comply with any technical limitations in the software that only allow you to use it in certain ways. You may not work around, remove or alter any technical limitations in the software.
You may not reverse engineer, decompile or disassemble the software.
You may not change, remove or obscure any copyright indication or other notification within the software or displayed by the software.
One license is limited to the computer you purchased it for. One virtual computer of any kind is to understand as a computer on its own in these terms. You may not extend one license to more than one computer. The license is not transferable.
 
2. Distribution requirements: You may distribute the software as part of a final application that you developed on the one computer you licensed it for. You must ensure by your own license terms that users of your software are not allowed to use or distribute the software named above any other than as part of your software.
In any case you may not distribute the software named above in a way that others may use it to develop software on their own using the software named above.
When distributing the software named above along with your own software, you must include into your software a reference to you as a copy right owner of your software in a way that therewith the relation of the software named above to you as a license owner can be seen.
 
3. Infringement Acknowledgement: You and Bassaly Computer Interfaces acknowledge and agree that, in the event of a third party claim that the software product named above or your possession or use of this software product infringes any third party's intellectual property rights, you (and not Bassaly Computer Interfaces) will be responsible for the investigation, defense, settlement and discharge of any such claim of intellectual property infringement. You will, however, promptly notify Bassaly Computer Interfaces in writing of such a claim.
 
4. Termination: If you fail to comply with any terms and conditions of this license, then this license and any rights afforded to you hereunder shall terminate automatically, without any notice or other action by Bassaly Computer Interface. Upon the termination of this license you shall cease all use of the software named above and uninstall it.
 
5. Disclaimer of Warranties: You acknowledge and agree that the application is provided on an "as is" and "as available" basis, and that your use of or reliance upon the applicaton and any third party content and services accessed thereby is at your sole risk and discretion. Bassaly Computer Interfaces and its affiliates, partners, suppliers and licensors herby disclaim any and all representations, warranties and guaranties regarding the software product and third party content and services, whether express, implied or statutory, and including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Furthermore, Bassaly Computer Interfaces and its affiliates, partners, suppliers and licensors make no warranty that (I) the software or third party content and services will meet your requirements; (II) the application or third party content and services will be uninterrupted, accurate, reliable, timely, secure or error-free; (III) the quality of any products, services, information or other material accessed or obtained by you through the software will be as represented or meet your expectations; or (IV) any errors in the software or third party content and services will be corrected.
 
6. Limitation of Liability: Under no circumstances shall Bassaly Computer Interfaces or its affiliates, partners, suppliers or licensors be liable for any indirect, incidental, consequential, special or exemplary damages arising out of or in connection with your access or use of or inability to access or use the software product named above and any third party content and services, whether or not the damages were foreseeable and whether or not Bassaly Computer Interfaces was advised of the possibility of such damages. Without limiting the generality of the foregoing, Bassay Computer Interfaces' aggregate liability to you (whether under contract, tort, statute or otherwise) shall not exceed the amount of fifty US Dollars ($50). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.
 
7. Support Services: Because this software is "as is," Bassaly Computer Interfaces may not provide support services for it.
 
8. Severability: If any provision of this agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
 
9. Amendments to this Agreement: Bassaly Computer Interfaces reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
